Brookdale Files Suit Against PharMerica Over Drug Prices

Brookdale Senior Living (NYSE: BKD) has filed suit against institutional pharmacy PharMerica (NYSE: PMC) over drug prices, according to reports from Louisville, Kentucky-based outlets, where the drug provider is based.

The suit alleges PharMerica has overcharged Brookdale for drugs provided to the senior living provider through more than two dozen of its assisted living communities and nursing homes. 

According to the reports, the allegations claim PharMerica “wrongly and “unilaterally” changed its pricing structure, essentially inflating prices for the company.

The damages Brookdale is seeking have not been disclosed, however, the suit includes 26 claims of at least $5,000 each for communities based in Denver, San Antonio and Charlotte. 

Brookdale declined to comment for the reports, while PharMerica had not been reached for comment. PharMerica had not filed a response to the court as of Wednesday, following the Sept. 24 filing.
